Members of regulatory bodies may have different roles, including membership of the council or a committee which draws up a code of conduct and membership of a disciplinary committee. To what extent are they incompatible? In the recent case of Holmes v Royal College of Veterinary Surgeons  UKPC 48 the Privy Council refused to accept that a past contribution, through membership of an appeal committee, to the exposition in the Code of standards of competence could fairly be regarded as predisposing a member of a disciplinary committee against a registrant, citing the case of Sadighi v General Dental Council  EWHC 1278 (Admin).
To this extent the Board have removed the apprehensions expressed by the present authors at para 9.44 of their book, Disciplinary and Regulatory Proceedings, 6th edition.
