Wall J. giving the judgment of the court held that the word "belief" in section 43B(1) of the ERA is plainly subjective. 'It is the particular belief held by the particular worker. Equally, however, the "belief" must be "reasonable". That is an objective test. I find it difficult to see how a worker can reasonably believe that an allegation tends to show that there has been a relevant failure if he knows or believes that the factual basis for the belief is false': Babula v Waltham Forest College [2007] EWCA Civ 174
