Composition of tribunal
The Northern Ireland High Court upheld a finding of a Conduct and Competence Committee of the Nursing and Midwifery Council after the complainant had argued that whilst dismissing two charges based on the evidence of a particular witness, it had nonetheless somehow allowed these allegations to influence its thinking.Gillen J noted that the tribunal consisted of a lay panel of three people chaired by a non-legally qualified person but with a legal advisor present throughout. He was of the view that such a tribunal would also be able to understand the proper approach to issues of law and be aware of the need to disregard irrelevant material.
