GMC Fitness to Practise panel
Rashid v. General Medical Council, Fatani v. GMC (2007) 1 WLR 1460 4. These two appeals from the GMC Fitness to Practice Panel reaffirmed the principal purpose of the Panel namely the preservation and maintenance of public confidence in the profession rather than the administration of retributive justice. Laws LJ reaffirmed that primacy should be given to the need to afford particular respect to the judgment of the professional decision making body in the form of the Panel and to give particular weight to any specialist tribunal. The High Court when correcting errors of fact or law should exercise a high degree of caution before supplanting their judgment on these issues and certainly not embark upon an exercise in resentencing.
