Judicial review of contractual relationships

The existence of a contractual relationship is not inconsistent with judicial review. Per Stanley Burnton J in Mullins, R (on the application of) v The Jockey Club [2005] EWHC 2197 (Admin). Local authorities have contracts with their tenants; this does not mean that their decisions to evict tenants are not challengeable by judicial review. See R (Heather and ors) v The Leonard Cheshire Foundation [2002] EWCA 366.
